FRIVOLOUS COPYRIGHT NOTICES
The DMCA requires that a claimant vouches for the accuracy of the copyright notices
under penalty of perjury, [DMCA § 512(c)(3)(A)(vi)]. By re-filing the same notices, Zycopolis
can't have it both ways. He either confesses to the
lack of authority for Patrick Savey to file
them
on its behalf in July 2011;
or the
inaccuracy of the notices where the proper
remedy is retraction. Either way,
notices which do not comply with
DMCA requirements are void and cannot serve
as such, [DMCA §
512(c)(3)(B)].
And once YouTube receives a notice, whether bogus
or not, it is required to takedown the
allegedly infringing material expeditiously.
Repeated notices
that are
sent to an empty
Internet location or URL
are redundant
and must be quashed
for being frivolous. Obviously, there is no DMCA
remedy to be had when the material has already
been taken down by YouTube after the first
